Many political parties are opposing this alteration made by the govt within the law of Jammu and Kashmir. Omar Abdullah termed the new land laws notified by the middle for Jammu and Kashmir as 'deceit' and 'breach of trust'.

Among the laws that are being completely repealed are Jammu and Kashmir Alliances of Land Act, Jammu and Kashmir Big Landed Estates Abolition Act, Jammu and Kashmir Common Lands (Regulation) Act, 1956, Jammu and Kashmir Consolidation of Hoddings Act, 1962 etc.

As per the new law enacted by the govt, now a citizen of any a part of the country should purchase land for house, shop and business in Jammu and Kashmir. Now there's no must have original residence proof to shop for land during this Jammu and Kashmir. However, the govt has continued to ban the sale of tilth to outsiders. But the land may be transferred to any non-cultivated land. This land are used for a few non-agricultural purposes, including the creation of an education institute, health care center. in step with the new rules, the sale of tillage won't be possible to any individual who isn't a farmer, unless the govt permits.

There was a separate system within the old law

There was a separate arrangement for purchasing land in Jammu and Kashmir. Here only those people that were ready to buy land had the initial residence certificate of the state. Under this law, people of other states of the country couldn't buy land in Jammu and Kashmir. However the lease arrangement for house, shop or business was in effect here.


The Central Government has amended the laws referring to Land Ownership Act in Jammu and Kashmir. Any citizen of the country can purchase land in Jammu and Kashmir. But there are many countries within the country, where it'll remain a dream for other states. Let's know ...


Special Right to Article 371 ...

6. Mizoram (371-G) - Local Mizo people have special rights in Mizoram. The ownership of the land here is within the hands of local tribal people only. However, outsiders can take land from the govt. to line up business.

7. Arunachal Pradesh (371-H) - Like other states of the Northeast, the local people are privileged. Here also people from outside the state cannot buy the land of local residents.

8. Karnataka (371-J) - Like Himachal Pradesh, only farmers should purchase land in Karnataka. The special thing is that quite one income people don't seem to be considered farmers. Before buying land for business, permission needs to be obtained from the regime.

9. Uttarakhand- Under Uttarakhand Zamindari Abolition Act Act, it's tasking for outsiders to shop for land within the state. to save lots of land from builders, cannot buy over a specified number of land.
